Affidavit of Heirship – An affidavit of heirship is a sworn document in Texas that testifies as to who a deceased person’s surviving heirs-at-law are. It is a document that is very useful in cases of estate distribution where the deceased had no will.

In this particular case, it was necessary because the deceased was killed as a pedestrian in a car collision. Our firm pursued a wrongful death case against the driver and his auto insurance carrier. When the case was successfully settled, the attorney had to obtain an affidavit of heirship to establish that the deceased had only one surviving heir-at-law, her biological daughter.
