AGs Provide Input on FTC-AG Collaboration Efforts

  • A bipartisan group of 30 AGs provided comments to the FTC on ways to improve collaboration between the FTC and AGs on protecting consumers from fraud and scams, as mandated by the FTC Collaboration Act of 2021.
  • The AGs’ comments note that increased collaboration between the FTC and AGs would provide the AGs with expanded access to the federal agency’s expertise and resources, as well as its national reach and facilitation of cross-border enforcement. They also assert that the Supreme Court’s decision in AMG Capital Management, LLC v. Federal Trade Commission, which limited the FTC’s authority to obtain consumer restitution, has negatively impacted collaboration between the states and the FTC.
  • The FTC will use the comments to provide a report to Congress regarding best practices to enhance collaboration to benefit consumers and the marketplace.
  • As we previously reported, the FTC also sought comments from the public on the efforts to enhance FTC-AG collaboration.
