The Alabama Department of Environmental Management (“ADEM”) and 43 Lime Products, LLC (“Lime Products”) entered into a March 11th Consent Order (“CO”) addressing alleged violations of certain Alabama air regulations.
The CO provides that Lime Products operates a stainless steel slag processing facility (“Facility”) in Washington County, Alabama.
ADEM is stated to have conducted an inspection of the Mount Vernon Facility on June 30, 2021, and observed it to be operating. The Facility subsequently submitted an air permit application at ADEM’s request on July 20, 2021. The request addressed sources of particulate matter emissions at the Facility.
ADEM is stated to have issued a Notice of Violation on August 18, 2021, for the alleged failure to comply with a provision of the ADEM Administrative Code.
Lime Products responded to the Notice of Violation stating they had begun slag processing operation at the Facility in April 2021. They further indicated that they would operate for just six to 10 more months with the slag materials currently on hand.
ADEM is stated to have issued a Synthetic Minor Operating Permit on November 23, 2021, to Lime Products.
Lime Products is stated to neither admit nor deny ADEM’s contentions.
A civil penalty of $5,000 is assessed.
