Air Enforcement: Mississippi Commission on Environmental Quality and Blue Mountain Mining Facility Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Blue Mountain Production Company (“Blue Mountain”) entered into an October 24th Agreed Order (“AO”) addressing alleged violation of a Clean Air Act Title V Operating Permit (“Permit”). See Order 7221 22.

Blue Mountain operates a mining facility in Blue Mountain, Mississippi.

Blue Mountain is stated to have been contacted by MCEQ on April 12th regarding an alleged violation of the Permit. The alleged violation is described as:

Condition 3.B.7: Respondent emitted 0.033 grams per dry standard cubic meter (g/dscm) of Particulate Matter (PM) from Emission Point AA-005 during a stack test on September 22, 2021. This exceeded the PM limit of 0.032 g/dscm.

Blue Mountain is stated to have submitted the results of a stack test by letter dated February 16th. Such test is stated to have indicated that Blue Mountain emitted 0.005 g/dscm from Emission Point AA-005. This value is stated to be below the permitted PM limit of 0.032 g/dscm.

A civil penalty of $19, 125 is assessed.
