Air Enforcement: Tennessee Air Pollution Control Board Proposed Order/Assessment of Civil Penalty Related to Lewisburg Die Casting Facility

The Tennessee Air Pollution Control Board (“Board”) issued a Proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) on August 9th to Allison Transmission, Inc. d/b/a Walker Die Casting (“Allison”).

The Order provides that Allison operates a facility (“Facility”) in Lewisburg, Tennessee.

The Facility is stated to operate an air contaminant source within the meaning of Tenn. Code Ann. § 68-201-102.

The Technical Secretary is stated to have issued Conditional Major operating permit number 464988P (“Permit”) to Allison on February 24, 2012. The Permit is stated to have been issued for the following air contaminant sources:

  • Ten Reverberatory Furnaces
  • Two Wastewater Evaporators
  • Four Abrasive Blasting Operations with two baghouses
  • One Reverberatory Furnace #10
  • Two Emergency IC Engines each with a Generator

Condition 15 of the Permit states in part:

Maximum individual HAPs including gaseous fluorine compounds (HF) and gaseous chlorine compounds (HCl) emitted from this facility shall not exceed 9.9 tons during all intervals of 12 consecutive months.

The Division of Air Pollution Control (“Division”) is stated to have received a letter from Allison dated January 9, 2021, providing notification of a hydrochloric acid exceedance for the 2020 calendar year. This is stated to have violated Condition 15 of the Permit.

The Division is stated to have conducted an inspection of the Facility on April 5th which included review of records. Additional exceedances of the single HAPs emissions limit are stated to have been discovered.

A proposed civil penalty of $8,000 is assessed.

The Order provides Allison certain appeal rights.
