Air Enforcement: Tennessee Air Pollution Control Board Proposed Order Addressing Luttrell Lime Manufacturing Facility

The Tennessee Air Pollution Control Board issued a May 20th proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to O-N Minerals (Luttrell) Company d/b/a Carmeuse Lime & Stone (“O-N”) addressing an alleged violation of a Clean Air Act Title V Operating Permit (“Permit”). See Case No. APC21-0185.

O-N is stated to operate a lime manufacturing operation (“Facility”) in Luttrell, Tennessee.

A Title V Major Source Operating Permit is stated to have been issued to the Facility on January 12, 2015. Condition E2(b) of the Permit is noted to state in part:

The first certification since issuance of this permit renewal shall cover the period from the issuance date through September 30, 2015, and shall be submitted within 60 days ... after the 12-month period ending September 30, 2015. Subsequent certifications shall be submitted within 60 days after the end of each 12-month period following the first certification.

The Division of Air Pollution Control is stated to stated to have received via email O-N’s Annual Compliance Certification (“ACC”) dated December 1, 2021, for the period of October 1, 2020, through September 30, 2021. It is alleged that based on the previously referenced permit condition that the ACC was due no later than November 29, 2021. As a result, it is alleged that O-N violated E2(b) of the Permit.

The Order proposes to assess a civil penalty of $1,500 for the alleged violation.

O-N is provided certain appeal rights pursuant to the Tennessee Code.
