Air Enforcement: Tennessee Air Pollution Control Board Order/Assessment of Penalty to Estill Springs, Tennessee Metal Preparation Operation

The Tennessee Air Pollution Control Board Technical Secretary (“Board”) issued a February 27th Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Universal Technologies, Inc. (“UTI”) addressing an alleged violation of an operating permit. See Case No. APC 17-0178.

The Order describes the Estill Springs, Tennessee facility as a metal preparation operation facility (“Facility”).

The Board is stated to have issued Operating Permit No. 050211P to UTI. (Emission Source Reference No. 26-0082-05).

The permit is stated to have included a Condition 5 which states:

The permittee shall apply for renewal of this permit not less than sixty (60) days prior to the permit’s expiration date pursuant to Division Rule 1200-3-9-.02(3).

The Division of Air Pollution Control is stated to have received an air operating permit renewal application for the metal preparation operation on or about September 19, 2017. Condition 5 of the operating permit is stated to have required the renewal application to have been received no later than February 1, 2008.

The Order states that a Notice of Violation was issued to UTI on October 17, 2017 for the alleged violation.

The Order alleges that by operating an air contaminant source not specifically exempted by Tenn. Comp. R. & Regs. 1200-03-09-.04 without first applying for and receiving the necessary operating permit, as discussed herein, UTI has violated Tenn. Comp. R. & Regs. 1200-03-09-.02 (2).

The Order assesses a civil penalty of $1,500.
