The Italian Antitrust Authority, together with the Guardia di Finanza (tax police), following the prior experience with 3 websites of counterfeited products branded Gucci, Prada and Ray Ban, at the end of last week blocked access in the Italian territory to 15 websites selling counterfeited Tod’s and Roger Vivier products.
As from the information provided by Indicam – the anti-counterfeiting institution who reported the complaints of the fashion houses – the consumers were deceived by the structure of the websites displaying prices consistent with the official websites.
Said conduct led the consumer to believe that the websites were owned by the official dealers and that the products were original. Moreover, the websites did not provide the consumer with the information requested by the applicable laws with regard to the right of termination and warranties (which obviously could not be effectively granted as the products are counterfeited).
The Authority is keeping a tough approach also against websites located abroad but accessible in the Italian territory. What additional measures can be used to protect your brand?
