Appellate court decision upholding dismissal of the State of California from this complex toxic tort case, which was brought by 32 plaintiffs who alleged a multitude of personal injuries from exposure to PCE and TCE. The court reversed Judge Holderman's post-trial dismissal of OCLI, while upholding all evidentiary rulings on motions in limine.
[Nota bene: the case was retried in 2009, in a 4-1/2 month jury trial which resulted in a complete defense verdict].
