The Arkansas Department of Environmental Quality (“ADEQ”) announced that the Arkansas Pollution Control and Ecology Commission (“APC&EC”) will hold a public hearing to receive comments on proposed amendments to emergency Regulation 36 (Used Tire Recycling and Accountability Program) on February 27th.

ADEQ has described Regulation No. 36 as providing the framework necessary for the agency’s implementation and administration of Act 317 of 2017, the Used Tire Recycling and Accountability Act. See Ark. Code Ann. § 8-9-401 et. seq.

ADEQ’s announcement describes the proposed revisions as:

• Simplifying the name of the program to the Tire Accountability Program
• Providing comprehensive program administration information in compliance with Act 317
• Including provisions for permitting, licensing, enforcement, and beneficial uses
• Removing preliminary implementation dates and deadlines that reference 2017
• Adding references to new or renamed forms
• Minor revisions that include correcting typographical, grammatical, formatting, and stylistic errors

The hearing will be held at 2:00 p.m. in ADEQ’s Commission Room which is located at 5301 Northshore Drive in North Little Rock, Arkansas.

The deadline for submitting written comments on the proposed regulation is March 15th.
