In light of the December 16, 2011 Opinion and Order in this case denying plaintiffs' motion for a preliminary injunction -- on the ground that they had failed to show a likelihood of success on the merits -- one of the plaintiffs, Ascentive LLC, seeks to exit from the case à la Emily LItella ("Never mind!") by making a motion to dismiss its own complaint without prejudice.

For the reasons set forth in this pleading, defendants opposed.
