CERCLA/Superfund Cost Recovery: U.S. Environmental Protection Agency and Seven Potentially Responsible Parties Enter into Consent Decree Addressing German Township, Ohio, Industrial Waste Landfill

The United States Department of Justice (“DOJ”) and seven Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”) potentially responsible parties (“PRPs”) entered into a May 20th Consent Decree addressing the Tremont City Barrel Fill Superfund site (“Site”) in German Township, Ohio.

The seven PRPs are stated to include:

  • Chemical Waste Management Inc.
  • Franklin International Inc.
  • International Paper Co.
  • The Procter & Gamble Co.
  • PPG Industries Inc.
  • Strebor Inc.
  • Worthington Cylinder Corp.

The Site has been described as a closed industrial waste landfill encompassing 8.5 acres. It is stated to have received from 1976 until 1979 approximately 51,500 drums and 300,000 gallons of industrial liquid waste.

The Consent Decree requires that the PRPs excavate and characterize drums and uncontained waste in the Barrel Fill. Described wastes are to be disposed of offsite. Further, the remaining hazardous and non-hazardous solid waste will be disposed of on-site in a newly constructed hazardous waste landfill.
