Interpreting revised Rule 56, the U.S. Court of Federal Claims recently denied a motion for reconsideration filed by the Government in a breach-of-contract case, Bay County, Florida v. United States. Bay County sued the United States for the Air Force’s breach of two utility contracts arising from the Air Force’s refusal to pay increased utility rates charged to Tyndall Air Force Base, and the trial court granted the plaintiff summary judgment based in part on Bay County’s Statement of Undisputed Facts to which the Government had not adequately responded.
