Delays inclusion of the US territories under the Medicaid Drug Rebate Program until April 1, 2022
 
CMS issued an Interim Final Rule that further delays the inclusion of the US territories in the definitions of “States” and “United States” for purposes of the Medicaid Drug Rebate Program.
 

Today, CMS issued an Interim Final Rule with comment period that further delays the inclusion of the US territories (American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, the Commonwealth of Puerto Rico, and the US Virgin Islands) in the definitions of “States” and “United States” for purposes of the Medicaid Drug Rebate Program from April 1, 2020 until April 1, 2022. There is a 60-day comment period for this interim final rule that will end on January 24, 2020.
