CMS Temporarily Rescinds Implementation of Enrollment Denials Related to Unpaid Medicare Overpayments

In the June 12, 2013 Payment Matters article “Enrollment Rules Continue To Provide Expanded Bases For Enforcement,” reference was made to CMS’ publication of Transmittal 469 to the Medicare Program Integrity Manual [PDF]. Transmittal 469 included CMS’ announced decision to implement certain proposed regulations that would have expanded the reasons to deny an enrollment application related to an unpaid Medicare debt by policy in advance of finalizing the regulations.

On July 30, 2013, CMS announced that it was rescinding Transmittal 469, which had an October 1, 2013 effective date. CMS explained that it was rescinding the transmittal “due to industry concerns” and that it would “be replaced at a later date.” It is unclear if CMS will simply address these industry concerns when making decisions regarding the final regulations or actually republish new policy guidance at a later date.
