This presentation addressed the benefits and drawbacks to co-trustee management, who can be a co-trustee, fiduciary duties, the duty to participate, the duty to cooperate, decision-making authority, delegation and directed trusts, the duty to disclose, deadlock issues, the duty to police co-trustees, the duty to sue co-trustees, and paying for attorney’s fees in co-trustee disputes.
