Pursuant to Florida law, the radon gas disclosure is not required for transactions involving unimproved properties. However, this disclosure is required on at least one document, form, or application executed at the time of, or prior to, a contract for sale and purchase of any building or execution of a rental agreement for any building.

Hazardous waste clean-up can be extremely expensive. For those reasons, especially for buyers of commercial property, and depending on the nature of the property being purchase, it may be prudent to obtain an environmental site assessment on property as part of your due diligence.
