Plaintiff is a Caucasian female. Plaintiff is living with her domestic partner former Correction Officer Steve Santiago (Hispanic Male). Plaintiff alleges that on or about March 12, 2007, she requested and was transferred to the Investigation Division. Plaintiff alleges that she informed defendant DENNIS WALL that former Correction Officer Santiago was involved in some sort of family conflict with respect to the distribution of his former spouse’s estate. Plaintiff alleges that she never reviewed former Correction Officer Santiago’s confidential file nor has she ever caused it to be reviewed for any purpose. Plaintiff alleges she was never accused by defendant’s RICHARD WHITE; DENNIS WALL or WILLIAM BARNES of reviewing former Correction Officer Santiago’s confidential file or caused it to be reviewed for any purpose. Plaintiff alleges that defendants’ RICHARD WHITE; DENNIS WALL and WILLIAM BARNES pre-supposed that former Correction Officer Santiago was guilty of misconduct because of his race. Plaintiff alleges that defendants’ RICHARD WHITE; DENNIS WALL; ALEXIS CASTIILO and WILLIAM BARNES failed to objectively investigate allegations of misconduct against her because they had already pre-supposed that she was guilty of misconduct because of her association with former Correction Officer Steve Santiago.
