Darovec Marketing Group v. Bio Genics


Darovec sued Bio Genics for breach of contract and defamation arising out of Bio Genics' termination of Darovec's distributor agreement. Bio Genics had received numerous complaints from customers and down line distributors of Darovec's, and had attempted to mediate the distributor's poor service record. The company eventually ended the distributor agreement because Darovec failed to remediate their problems. Bio Genics sent out a letter to Darovec's related upline and downline distributors describing the reasons for the shift in the sales line. Darovec claimed that the letter was defamatory. Bio Genics moved for summary judgment based on the non-specific denials of Darovec.
