Debtors' Request for Certification of Direct Appeal to the Ninth Circuit


Series of court filings from In re Balas & Morales, the California case in which twenty bankruptcy judges jointly signed an opinion striking down the federal Defense of Marriage Act (DOMA) as unconstitutional to the extent it barred lawfully married same-sex couples from filing joint bankruptcy petitions.

This is the debtors' request that the U.S. Trustee's appeal be heard directly by the Ninth Circuit, so that binding appellate guidance could be established. It includes a series of declarations from local bankruptcy trustees attesting to the need for uniform guidance on this issue.
