This case covers all purchasers of the common stock of Netopia, Inc. (“Netopia”) during the period from November 11, 2003 through August 16, 2004.

Schatz Nobel Izard, P.C. was appointed as Lead Counsel by the United States District Court for the Northern District of California on December 3, 2004. An Amended Complaint, filed on January 3, 2006, alleges that Netopia and certain of its officers knowingly or recklessly made a series of material misrepresentations concerning Netopia’s earnings, product costs, and sales to its largest customer.

This is the Defendants' memorandum in opposition to class certification. By an order entered on June 21, 2006, the Court certified the action to proceed as a class action.

On June 8, 2007, U.S. District Judge Ronald Whyte gave final approval to a $11.25 million settlement.
