Defendant argues that the Court should strike plaintiff's duty to control claims against assailant's mother under Restatement (Second) of Torts §316, §319, and the common law. Plaintiff's husband is alleged to have died prematurely after being thrown to the ground by a mentally incompetent 18-year-old whose mother, who was aware that her son's mental condition was like that of a child and of his troubled behavioral history, was responsible for his day-to-day care and needs.
