Delaware Tightens COVID-19 Restrictions

Delaware has introduced additional restrictions on individuals and businesses aimed to curb the recent spike in COVID-19 infections. On November 17, Governor Carney announced forthcoming amendments to his emergency order. Among other things, indoor gatherings are capped at 30% fire capacity up to 50 people, and indoor gatherings inside homes are limited to 10 people.

On November 23, 2020 at 8 am, the following restrictions will take effect:

  • Indoor gatherings (other than in private homes) are capped at 30% of the venue’s fire capacity, and cannot exceed 50 people regardless of fire capacity
  • Restaurants are limited to 30% fire capacity for indoor seating, and may offer additional outdoor seating
  • Outdoor public gatherings are limited to 50 people. Gatherings up to 250 people may be permitted at the discretion of the Delaware Division of Public Health
  • Indoor gatherings in private homes are limited to no more than 10 people

As of December 1, 2020 at 8 am, Delaware youth sports teams will not be permitted to travel across state lines to attend tournaments. The teams also may not host tournaments with out-of-state teams.

Delaware courts rolled back their reopening plan to Phase 2. Under this phase, the courts will remain open to the public, but the courts will not conduct jury trials.
