January is the month of renewal – closing the door on the negativity of the prior year and planning for the challenges of the new year. Planning for a divorce and new life may seem daunting. When going through the divorce, marital assets and debts will need to be divided between the parties. For those spouses who own a business as a marital asset, getting divorced and reaching a fair division of the marital estate can be even more complicated. Practically speaking, while the divorce works through the process, the business will need to continue to operate.
