The Court of Special Appeals of Maryland recently ruled that life-saving treatment does not negate subsequent malpractice on behalf of a health care provider. In seeking to overturn a jury verdict of $3.6 million, the University of Maryland Medical System (“UMMS”) had argued that health care providers should be protected from Maryland medical malpractice liability when their efforts were at some point life saving.
