On October 4, 2010, the Illinois Appellate Court, Second District, issued the first major opinion since a Fourth District decision rejected the "legitimate-business-interest" test for determining the reasonableness of restrictive covenants. Although the case can be read as providing some guidance to those drafting and... trying to enforce or defend against restrictive covenants, the decision leaves employers and their attorneys wanting more.
