The Pacific Coast Federation of Fishermen's Association and the Natural Resource Defense Council were denied intervention in a takings case arising out of the San Joaquin River Restoration Settlement Act. The takings case, brought by landowners whose agricultural land will be flooded by releases required in the settlement have a takings case pending the U.S. Court of Federal Claims. The environmental groups sought to intervene, but the trial judge denied their motion, stating: "The applicants' interests would suffer harm from an adversse judgment only if a chain of possible but uncertain events were to take place."
