Environmental Update-January 2011


The first case analyzes the State's attempt to avoid NPDES compliance in the hopes of treating to technology-based standards, and not the more stringent, water-quality based standards. The second case enforces the Northwest Compact's regulation of low-level radioactive waste. The third case confirms a private plaintiff's right to sue for environmental harm to the extent they are not part of a consent decree between the government and the polluter.
