As summer draws to a close, the volume of litigation filed under the Fair Labor Standards Act shows no signs of letting up.
As of August 27, roughly two-thirds of the way through the year, 5,287 lawsuits had been filed under the FLSA, according to statistics tracked by Justia.com. If that pace continues, 8,074 lawsuits will have been filed by the end of the year - an increase of 15 percent over the previous record of 7,109 lawsuits set in 2011.
As the following table illustrates, FLSA litigation has been steadily rising over the past several years.
Employers should carefully review their wage and hour practices to help ensure they are compliant in the event of a lawsuit.
