H-1B Cap Update: Employer Registration Accounts

Moore & Van Allen PLLC

The registration period for H-1B cap-subject petitions is rapidly approaching! As a reminder, the registration window opens at noon ET on March 9, 2021 and closes at noon ET on March 25, 2021. All beneficiaries must be registered during this period in order to be entered in the FY 2022 H-1B cap selection lotteries.

In order to complete this essential step, each entity must have an active registration account in the USCIS system and the account holder must be available via email during the registration window. If your organization created a registration account last year, that account may be reused for the FY 2022 cap season so long as the account holder remains the same. If a new account holder needs to be created or your organization does not already have a registration account, instructions for setting up a new account are below. If you would like to get your account set up in advance, see instructions for setting up a new account below:

New Account Setup -

To create a new H-1B registration account, go to https://my.uscis.gov/ and click, “Sign Up.” You will need to:

·     Provide a unique e-mail address for the account. The account holder must be available to complete the final step during the registration window.

·     Create a password.

·     Select your preferred method for two-factor authentication. Acceptable two-factor authentication methods include SMS text messaging, an email address or the use of an authentication app.

·     Provide answers to several security questions, which will allow you to reset your password at any time.

·     Select your account type, which is, “I am an H-1B Registrant”

Please be sure to select the H-1B Registrant account type. Selecting a different account type will block the user’s e-mail address from the H-1B registration process.

There will be two lotteries run between March 25 and March 31, 2021. The first lottery will contain all registered H-1B beneficiaries. USCIS will use this lottery to select enough registrations to meet the regular H-1B cap of 65,000. The second lottery will contain all registered advanced-degree cap beneficiaries who were not selected in the first lottery. USCIS will use this lottery to select enough registrations to meet the H-1B cap exemption of 20,000 for holders of U.S. advanced degrees. USCIS plans to notify employers and immigration counsel of the lottery results by March 31, 2021. The petition filing period begins on April 1, 2021 and will end no earlier than June 30, 2021.
