Hazardous Waste Enforcement: Alabama Department of Environmental Management and Glencoe Commercial Hazardous Waste Transporter/Transfer Facility Enter into Consent Order

The Alabama Department of Environmental Management (“ADEM”) and American Transportation Solutions, LLC (“ATS”) entered into a December 14th Consent Order (“CO”) addressing an alleged violation of the Alabama Hazardous Waste Regulations. See Consent Order No. 23-XXX-CHW.

The CO provides that ATS operates a commercial hazardous waste transporter/transfer facility (“Facility”) in Glencoe, Alabama.

The Facility is stated to utilize an EPA Identification Number and as a result of its operations is a hazardous waste transporter/transfer facility and a very small quantity generator of hazardous waste.

A representative of ADEM’s Industrial Hazardous Waste Branch is stated to have conducted a Compliance Evaluation Inspection (“CEI”) of the ATS Facility on June 22nd. The CEI and a review of ATS compliance is stated to have shown the following:

  • ATS stored hazardous waste at the Facility for more than 10 days without a permit

ATS neither admits nor denies ADEM’s contentions.

The CO assesses a civil penalty of $8,800.
