Hazardous Waste Enforcement: Alabama Department of Environmental Management and Lamar County Commercial Hazardous Waste Treatment/Storage Facility Enter into Consent Order

The Alabama Department of Environmental Management (“ADEM”) and US Ecology Sulligent, Inc. (“US Ecology”) entered into a March 24th Consent Order (“CO”) addressing an alleged violation of provisions of the ADEM Administrative Code related to hazardous waste. See CO No. 21-XXX-CHW.

US Ecology is stated to operate a commercial hazardous waste treatment and storage facility (“Facility”) in Lamar County, Alabama.

The Facility is stated to operate under a Alabama Hazardous Waste Management and Minimization Act (“AHWMMA”) permit. As a result of its operations, it is stated to be classified as a hazardous waste treatment and storage facility. It is also stated to constitute a large quantity generator of hazardous waste.

US Ecology is stated to have notified ADEM on December 7, 2020, that it had stored two containers of hazardous waste, restricted from land disposal, at the facility for greater than one year.

US Ecology is stated to neither admit nor deny ADEM’s contentions.

A civil penalty of $8,800 is assessed.
