The United States Environmental Protection Agency (“EPA”) and Solaris Pharma Corporation (“SPC”) entered into an August 1st Expedited Settlement Agreement (“ESA”) addressing an alleged violation of the Resource Conservation and Recovery Act (“RCRA”) regulations. See Docket No. RCRA-02-2022-7203.
SPC is the owner or operator of a pharmaceutical manufacturing facility (“Facility”) in Bridgewater, New Jersey.
EPA is stated to have conducted a review of e-manifest data of hazardous waste shipments from the Facility. Further, the federal agency is stated to have had discussions with SPC regarding its findings.
The ESA provides that EPA determined that SPC failed to have an EPA identification number prior to transporting or offering for transport hazardous waste from its Facility.
The Facility is stated to have shipped hazardous waste during the years 2018-2021 and used hazardous waste manifests without having received an EPA identification number from the New Jersey Department of Environmental Protection. This is alleged to be a violation of 40 C.F.R. § 262.12.
SPC neither admits nor denies the allegations contained in the ESA.
A civil penalty of $1,250 is assessed.
