How Much Can I Expect from Workers Comp Benefits?

When a worker is injured or becomes ill on the job in New Jersey, his or her employer pays for medical treatment as well as disability benefits. The New Jersey Department of Labor and Workforce Development provides a table that gives filers an idea of workers compensation benefit rates to expect. Qualifications and rates for 2012 include:

  • Temporary total disability for disabilities lasting more than seven days: $810 maximum/$216 minimum (70 percent of wages)
  • Permanent partial benefits, based on a percentage of scheduled or non-scheduled losses: $810 maximum/$35 minimum (depends on type and severity of injuries)
  • Permanent total benefits for a disability that prevents the worker from returning to any gainful employment: $810 maximum/$216 minimum (70 percent of wages)
  • Death benefits:  $810 max

The table states that statewide average weekly wages were $1,079.91in 2010 and $1,056.54 in 2009. Another factor is whether the injured body part is a scheduled or non-scheduled loss and the percentage of disability. Scheduled losses include injury or loss of the following body parts:

  • Fingers
  • Hands
  • Arms
  • Toes
  • Legs
  • Ears
  • Eyes

For example, if a worker loses 50 percent of the vision in one eye, he or she would receive $22,744 for 100 weeks, while a worker with total vision loss in one eye would receive $75,600 for 200 weeks. Non-scheduled losses are more general, such as injuries to the back, lungs, or heart. The employer has the right to designate the authorized physician to diagnose and treat work-related injuries.

In the event a worker dies due to a job-related injury or illness, his or her dependents may be eligible to receive death benefits and the employer or its insurance carrier must pay up to $3,500 for funeral expenses.
