  • 21 Democratic AGs filed an amicus brief with the U.S. Court of Appeals for the Fifth Circuit asking it to overturn a preliminary injunction barring communication between federal officials and agencies and social-media platforms regarding content moderation.
  • The underlying preliminary injunction was issued by the U.S. District Court for the Western District of Louisiana in a lawsuit brought by the Louisiana and Missouri AGs in which they allege that the federal entities are using coercive means to restrict freedom of speech on social media platforms.
  • In the amicus brief, the AGs argue that the preliminary injunction is counter to the public interest and chills mutually beneficial, non-coercive discourse between the government and social media companies on topics such as child safety, consumer protection, and election integrity.
