The Affordable Care Act requires prescriptions before over the counter drug purchases can qualify as tax deductible medical expenses reimbursable on a tax free basis. The new rules have created challenges for health flexible spending account plans, health reimbursement plans and other arrangements, particularly when drug cards are used for reimbursement. This new guidance broadens when drug cards can be used, but still leaves significant challenges in place.
