ITC Making More Good Faith Offers for Adams-Spokane Line in Macomb County

ITC is seeking expanded vegetation management rights from property owners in Washington Township.

I was recently contacted by a property owner who received a good faith offer from ITC. The good faith offer seeks expanded vegetation management rights that will encumber the owner’s entire backyard and portions of his side yard. 

A good faith offer is a statutory prerequisite to filing a condemnation lawsuit. I expect ITC to be filing lawsuits in November or December based upon the timing of past projects.  Condemnation lawsuits will be filed in Macomb County Circuit Court. 

I am already representing other property owners in Macomb and Oakland County Circuit Court for lawsuits filed along this transmission line. 

Given the timing of these lawsuits, it is important for property owners confronted with a good faith offer to take photographs of the impacted areas while leaves are still on the trees so that the true impact of the loss of these trees can be measured.
