Kentucky Court of Appeals Opinion


This is a recent opinion from the Ky Court of Appeals regarding KOSHA fines issued to a drilling company. The Court reversed the Franklin Circuit Court opinion (which was in the employer's favor) and found in favor of the Kentucky Labor Cabinet. The Court of Appeals determined that the citations were proper even though the employer was not present for the opening conference and walk around inspection and the hazard was abated before the citation was issued.
