La Réforme du droit des contrats d’assurance : une tâche de Sisyphe ?


This is the French text of my paper setting out a few observations on the history of the Marine Insurance Act 1906, and the current reform programme..

"Le Marine Insurance Act de 1906 sur l’assurance maritime témoigne de

l’effervescence intellectuelle victorienne et marque l’aboutissement d’une réflexion

considérable engagée vers la fin du règne de la reine Victoria. Douze années furent

nécessaires afin que le projet devienne un texte de loi et, en ce sens, on peut le

qualifier d’édouardien. Ce texte constitue probablement l’une des contributions

législatives majeures à la prospérité de la City de Londres (et par là-même, de la

Grande-Bretagne), tout comme d’autres initiatives victoriennes continuent de

marquer l’économie britannique de leur empreinte, à l’image, par exemple, de

l’infrastructure ferroviaire londonienne.....".
