The Mine Safety and Health Administration ("MSHA") recently released a document entitled "Contested Penalty Date- FY 2008-2009"[1] containing data on the disposition of cases contested before the Federal Mine Safety and Health Review Commission ("Commission"). The data was requested by the U.S. House Education and Labor Committee which is apparently investigating claims by MSHA officials that mine operators are abusing the Commission's procedure for contesting MSHA citations and penalties.
