Local Governments and Industry Providers Comment on FCC Rulemaking

Local governments and wireless tower and service providers – more than 200 participants in total – filed comments with the FCC on Monday in response to the agency’s new proposed rules that would limit local and state authority to deny requests to modify existing wireless towers or base stations.

As several local government filings pointed out – including the filing made by Best Best & Krieger on behalf of a coalition of local governments, local government associations and non-profit groups – the proposed rules could be read to allow a wireless provider to make significant changes to existing wireless facilities without complying with local safety, environmental protection and historical preservation requirements.

Next step: a reply round with filings scheduled for March 5. Communities interested in reviewing the filings made thus far can find them here. I highly encourage communities to participate in the debate.
