The Arkansas Department of Environmental Quality (“ADEQ”) issued a guidance document titled:

Managing Debris from Declared Disasters (“Guidance”)

ADEQ states that the document is being issued in response to the June 2019 flood disaster in Arkansas.

Natural disasters such as wildfires, floods, earthquakes, hurricanes, tornados, etc., usually generally a great deal of debris. Natural disaster debris typically refers to material and waste streams such as building materials, sediments, vegetative debris, and personal property. Handling new debris may potentially trigger a variety of state and/or federal regulatory requirements. Depending upon the amount of debris generated, quantities may need to handled that are greater than the amount of waste a typical community handles each year.

The ADEQ Guidance document addresses a variety of topics, which include:

  • Disposing of Debris (including a list of debris that may be generated)
  • Applicability
    • County or municipal solid waste operators
    • Persons other than authorized county or municipal solid waste operators
  • Disaster Declarations
  • Sorting and Stockpiling Debris Before Disposal or Burning
