Author and Williams Kastner Member Christopher Marks is interviewed by The Metropolitan Corporate Counsel in the publication’s April 2009 edition regarding strategies for cost controls in litigation in the current economic recession. In the interview, entitled “Managing Litigation Costs in Difficult Times,” Marks notes that the “advent of electronic discovery,” coupled with the country’s severe economic recession, has contributed to a sharp rise in the cost of litigation. In order to curb these litigation costs, Marks advises businesses to engage in frequent case updates with their attorneys, the consideration of alternate fee arrangements, and “early assessments of both the risks and the benefits of taking certain courses of action.” Litigation costs can also be controlled at law firms, Marks suggests, by employing the use of new technologies and optimizing efficiencies.
