Medical Malpractice at the Dentist’s Office? It Happens!


Many medical malpractice claims are filed because of an incorrect diagnosis or an improper medical procedure performed by a physician. However, malpractice is not exclusive to medical doctors in California. Things can go wrong at the dentist’s office, too.

You may not hear as much about medical malpractice by dentists but it happens. Mistakes by the dentist can cause severe pain and damage your overall health. The state regulates the practice of dentistry through the Dental Board of California. The statutes and regulations set forth by the Dental Board apply to dentists, registered dental assistants and registered dental hygienists.

Whether you are going to the dentist for a routine exam or to a periodontist to treat gum disease, you are protected. Unfortunately, negligence at the dentist’s office can occur and complications can be immediate or appear sometime after your treatment. If you have persistent pain and you think it was caused by your dentist’s actions, you might have a case against him or her.

Negligence by the dentist or a member of his or her staff can include:

- A wrong diagnosis

- Misuse of anesthesia

- Use of unsanitary or unsterilized equipment

- Wrong prescription of medication and tongue injury
