Medical Waste Enforcement: Alabama Department of Environmental Management and Colbert County Medical Waste Transporter/Treatment Facility Operator Enter into Order

The Alabama Department of Environmental Management (“ADEM”) and KTT, LLC d/b/a Med Rid Medical Waste Services (“KTT”) entered into a September 9th Special Order by Consent (“Order”) addressing alleged violations addressing certain requirements of Division 17 of the ADEM Administrative Code and certain medical waste permits.

The Order provides that KTT operates a medical waste transporter and treatment facility with certain ADEM permit numbers in Colbert County, Alabama.

The Order provides that on December 15, 2020, in response to a complaint, representatives of ADEM’s Environmental Service Branch and the United States Department of Transportation (“DOT”) Pipeline and Hazardous Materials Safety Administration conducted an inspection of the KTT facility.

The inspection and review of KTT is stated to have included a review of the company’s compliance with certain requirements of Division 17 of the ADEM Administrative Code and KTT’s medical waste permits.

The inspection allegedly identified the following violations:

  • Medical waste containers or transporters that were not properly sealed or labeled
  • Two transport vehicles are operated with permeable wooden flooring, which showed signs of wear and staining
  • Two transport vehicles did not exhibit the facility’s ADEM permit number
  • Failure to provide documentation or any other means of proof that the autoclave was being evaluated for effectiveness during each run
  • Failure to maintain a written log or any other means of documentation for the steam sterilization unit

KTT neither admits nor denies ADEM’s contentions.

A civil penalty of $7,300 is assessed.
