Specific to Washington State law. The trooper had the defendant under arrest and asked him to blow into the breath test machine (Datamaster.) The defendant did so but the machine showed an error entitled "invalid sample." The trooper then told the defendant that he had to submit to a blood test. This brief argues that the trooper had no authority to request a blood test under these facts.
