Summary

The chapter 7 Trustee for Ausam Energy Corporation and Noram Resources, Inc. sued Ausam/Noram's pre-petition creditor, Huff Energy Fund LP and Barry Borak, a former director of Ausam, for breach of fiduciary duty and civil conspiracy. The Court has already dismissed most of the claims against Huff on the basis of res judicata. The court now grants in part and denies in part a second motion to dismiss on the basis of judicial estoppel and res judicata.
