New Jersey Supreme Court Grants Leave For Oral Argument On Behalf Of Amici Curiae Trade Associations In Multicounty Litigation In Re: Accutane

The New Jersey Supreme Court has granted leave for McCarter to argue on behalf of amici curiae HealthCare Institute of New Jersey, New Jersey Business & Industry Association, Commerce and Industry Association of New Jersey, and the New Jersey Chamber of Commerce, in support of Defendants-Petitioners Hoffman-La Roche, Inc. and Roche Laboratories, Inc. in connection with long-running multicounty litigation titled In re: Accutane. A central issue before the Court in this matter is the admissibility of expert testimony. New Jersey still allows lay juries to decide whether expert testimony is junk science or not, which flies in the face of the scientifically-based methodologies and peer review that the life sciences industry employs. We will argue that the widely accepted Daubert standard should be applied in New Jersey state courts.
