The New Jersey Supreme Court's decision on the source-code issue relative to the Draeger breath test maching used throughout the state of New Jersey and the United States to test breath for alcohol content in drunk driving arrests. The opinion largely supports the Appeals Court decision and adopts in part the recommendations of the Special Master appointed in the case. This is a partial rather than a complete victory for the defense team in this case. This opinion will certainly have an impact on the viability of future source code issues raised in other states relative to the Draeger and other breath testing machines in all drunk driving cases.
