NJ BPU Affirms OAL Decision Denying Municipality the Right to Compete in Existing Franchise Area

In August 2013, the New Jersey Board of Public Utilities (the Board) issued an order affirming an initial decision of the New Jersey Office of Administrative Law (OAL), which estopped the Borough of Woodland Park from constructing a parallel water system and competing against New Jersey-American Water Company, Inc. (NJAWC) in its franchise area.  NJAWC was represented in the matter by Cozen O’Connor.
